Terms and conditions

If you choose to use, access, or connect to the Changew website and/or services, you will be acknowledging that you have read and understood the following terms of use, including the terms of our Privacy Policy, and you agree to be bound by them and to comply with all applicable laws and regulations regarding the use of the Changew website and/or services. We reserve the right to update these Terms from time to time without notice. Any changes that we make will become part of these Terms when we make them. So, please review these Terms periodically. If you cannot agree to these Terms, or to our Privacy Policy, please do not use the Service. And if You have any questions about them, don't hesitate to contact support@changew.com.

Privacy and Communications

You acknowledge and agree that Changew may send You e-mails related to your account and/or the Service.

Sign up and Registration

In order to use portions of the Service, you must sign up with Changew (thereby becoming a “User” and creating an “Account”). Information provided during the registration process must be complete and accurate.

You shall not: a) create an account with the intent to impersonate another user or person; or b) employ a username that is offensive, vulgar, or of other ill regard as defined at the sole discretion of Changew.

Any use of another User’s account of Services may only be permitted with the express permission of the User.

You are solely responsible for all activity performed on your account. It is your responsibility to protect the safety and security of your account’s password. In the event of a security breach or suspected security breach, you are required to provide notice to Changew without delay.

You may not access the Services in an attempt to modify, publish, distribute, transmit, systematically download, use automated means to index or extract data from, participate in the transfer or sale or rental of, translate, create derivative works from, frame, co-brand, or in any way exploit any part of the Services other than for personal or internal business use or as specifically permitted in this agreement, without Changew’s written consent. You agree to immediately cease use of the Services at Changew’s request.

Eligibility and Compliance

Changew may, at any time at its sole discretion, refuse to offer the Services to any User, individual or entity without notice including but limited to entities with a paid for (“Upgraded”) account and a free account. Changew may delete or otherwise disable any User’s account without notice or explanation. By accessing the Services, you acknowledge and agree that you will not directly or indirectly attempt to copy, replicate, reverse engineer, decode, or acquire any frontend or backend source code except as expressly permitted by Changew or corresponding laws and regulations. You will not attempt to alter, modify, or otherwise derive another product or work based on or otherwise employing use of the Services.

Use of the services, Restrictions and Limits

Changew Services may access 3rd-party websites, webpages, URLs and files including (a) text, (b) images, (c) code and other components (“External Content”) that are otherwise available to the general public or to the User. Changew uses proprietary technology to enable Users to automatically and programmatically access External Content at a User-specified cadence and store External Content (“Crawl”). Changew will not knowingly or intentionally circumnavigate any 3rd-party security, obfuscation or privacy parameters in the delivery of its Services, including but not limited to the Crawling of External Content.

You represent and warrant to Changew that you are authorized, or otherwise legally permitted, to access and Crawl any webpage or website that you direct Changew’s Services to Crawl. In the event that User is for any reason no longer authorized or permitted to Crawl any webpage or website, User shall immediately discontinue use of all relevant Services.

In the course of your use of the Website and Services you may not, and agree not to (a) reproduce or circumvent the navigational structure or presentation of the Website or Services to obtain, or attempt to obtain, any materials, documents or information through any means not purposely made available to you through the Services AS-IS; (b) attempt to gain unauthorized access (by hacking, password “mining” or any other means) to (i) any portion or feature of the Services, (ii) any other system or network connected to the Services, (iii) any Changew server, or (iv) any of the services offered on or through the Services; (d) probe, scan or test the vulnerability of the Services or any network connected to the Services; (e) breach the security or authentication measures on the Services or any network or system connected to the Services or any webpage or website being Crawled by the Services; (f) exploit the Services, or any service or information made available through the Services; or (g) use any device, software or routine in order to interfere, or attempt to interfere, with (i) the proper working of the Services, (ii) any transaction conducted on the Services, or (iii) any third party’s use of the Services; (h) or use the Services for any purpose that is unlawful or otherwise prohibited.

“Content” refers to and includes any data, image, company name, logo, text, style, pattern, document, asset, feature or functionality used on or affiliated with Changew and its Services whether created, uploaded or otherwise employed by Changew, its Users or affiliates.

User may not use Changew to defraud or manipulate any Online Services or their operators, including advertising networks, polling, surveys, or voting systems.

User may not use Changew in any manner that materially negatively impacts the performance of or materially limits the ability of others to use any Online Services, or otherwise causes any damage to the integrity or stability of any Online Services. Moreover, User will not use Changew in any manner that might be construed as a denial of service attack on any Online Services.

User may not use Changew to monitor anything illegal. To be specific, we may not allow the following businesses or types of websites to monitor with Changew:

  • Websites offering to sell illegal goods or services
  • Pornography/sexually explicit content
  • Escort services
  • Other websites that we find, in our sole discretion, hurt our reputation or our deliverability

Using Changew does not give you ownership of any intellectual property rights in Changew or the Content you access through it, including External Content. Changew may use Content generated by or affiliated with you including but not limited to text, images, logos, company name, branding, styles and likeness for purposes including but not limited to marketing, promotion, benchmarks, reporting, press releases, and public relations unless otherwise contractually agreed to or prohibited by law

Refunds

Refunds following the termination of a user agreement are conducted as follows:

  • Refunds are not issued for services past the date of agreed use.
  • Refunds are not given to users whose violated the Terms and Conditions of their own volition.
  • Additional fees incurred during checkout are not refundable.
  • Previously expended payments (payments made for services received in the past) are not refundable.

Regarding refunds for unused funds:

  • If paid services are used once or more during the current pay-period, the current month’s payment will be considered as expended. Not including expended funds, any funds paid in advance for future months will be refunded.
  • If more than 30 days have passed since the date your subscription was billed, a refund cannot be issued, regardless of whether you have used our services. You may get a prorated refund, and the amount will be calculated based on the unused months left on your subscription plan.
  • The refundable amount is equal to the standard monthly payment amount stipulated in the financial agreement made when funds are first added. This is regardless of any promotions the customer applied when entering into the contract, and all customers will be subject to the same refund calculation method.
    • For example, a customer who purchases a regular $90 price per-month yearly subscription plan, and a customer who purchases the same plan at a promotional price of $50 price per-month will both have the regularly contracted $90 per-month deducted from their refund depending on how many months have passed.
  • In the case of a refund request, if your account balance is less than zero, the contract will be terminated without a refund and you will be notified.
  • Separate from the monthly payment, the "account setup fee" will not be refunded if 14 days have passed since you made the account.
User rights and obligations

You have the right to use the provider services at your own discretion, except in the case of agreement cancellation, terms of use violation, or in situations not covered by the provider’s limitations of liability.

You may contact the provider about service related issues or questions, however the provider is not bound to respond to all inquiries.

As customers it is your right to demand that services be properly rendered according the terms of service and applicable laws.

Users are asked to alert the provider if they encounter any technical issues or critical weaknesses in the service.

You must be truthful in your submission of personal information and contract signings. If you register false or incorrect information, you may forfeit legal rights, and the provider will not be liable for any damages incurred.

If personal information that is essential to the usage agreement changes, such as your email address, you are responsible to update the relevant information on the provider website.

You are responsible for maintaining the confidentiality of your login and password information. The company will not be held liable for any problems caused by negligent management of this information.

You affirm that you will comply with the Terms and Conditions of the user agreement.

Provider Obligations

Changew provides services in good faith according to the stipulations set forth in this agreement.

The provider is required to maintain and repair equipment, and in the event of a failure or service outage must do their best to make speedy corrections and preserve user data.

The provider must establish a security system to protect your personal information and comply with the privacy policy.

We strive to ensure a convenient experience for you while we keep our end of the Terms and Conditions agreement.

Limitations of Liability

The provider will not reimburse users for any failure that occurs during regular use which directly or indirectly result in damages. You should be aware of the possibility of failure and the limitations of the service and should plan and use the service accordingly.

The provider has no obligation to store and manage the user's usage history, and users must back up needed usage history regularly.

The provider shall not be liable for any specific content that is not determined by the details of the user contract.

The provider shall not be liable if services cannot be provided due to war, natural disasters, national emergencies, and/or other technical defects that are outside of the provider’s immediate power to resolve.

The provider shall not be liable for the interruption/failure of services due to reasons attributable to the user.

The provider shall not be liable for any damages incurred to the user due to outages and/or problems occurring in ISP or mobile provider networks that prevent users from accessing services.

The provider shall not be liable for any process of data reuse. You will be responsible for the legal consequences that occur in the process of data reuse.

Personal Data and Intellectual Property

The provider is obligated to protect user information, as stipulated in the Privacy Policy, however we may use information collected during regular operations to improve the service's algorithm, quality control, and customer service.

The provider does not use user information entered by the user without permission and only sends promotional emails if users agrees to receive them. We may collect user PC specification information to detect errors during service and provide greater stability.

You acknowledge and agree that the Company and its licensors retain ownership of all intellectual property rights of any kind related to the website and service (except for user content, third-party content, and public domain content), including applicable copyrights, trademarks, and other proprietary rights. Changew reserves all rights that are not expressly granted to you under these Terms and Conditions.
